Calverley Square opponent handed £5,428 bill for case ‘without merit’

Brian Ransley sought a High Court Judicial Review in July to examine the process behind the Calverley Square civic complex and theatre.

The former Conservative councillor has long-opposed the £90million project and unsuccessfully stood for the Tunbridge Wells Alliance party in May’s elections.

A judicial review was one of the few options available to oppose the complex, which Town Hall members voted through in December and then granted planning permission.

It is a process that seeks to prove the working behind a planning decision was unlawful, rather than the decision itself.

The court decided in August 2 to reject the appeal for a judicial review and ordered he pay court costs of £5,428.38.

Tunbridge Wells Borough Council revealed the figure for the first time in documentation this week.

This stated: “The decision was to refuse the application for a Judicial Review.

“The decision highlighted that the case was totally without merit. In addition costs were awarded to be paid by the claimant to the council.

“The council is still awaiting payment of the costs incurred.”

Mr Ransley served as a councillor from 2008 to 2012.
